Dividing an apartment block into freehold apartments is governed by the German Act on Cooperative Apartments (Wohnungseigentumsgesetz – WEG). The notarial shared ownership deed defines the freehold ownership of the individual apartments and the common property. The shared ownership deed also contains specific provisions on parking spaces, basement areas, etc. In addition, the shared ownership deed includes rules relating to co-ownership. The co-ownership rules set out the arrangements for managing the homeowners’ association, in particular regarding owners’ meetings, the appointment of a homeowners’ association/property manager and the apportionment of costs.
