
Since August 2022, civil law notaries have been permitted to notarise documents via video conference in certain cases. At present, this only applies to the formation of a GmbH and a ‘UG (haftungsbeschränkt)’ (a restricted form of limited liability company designed for start-ups) as well as all registrations in the commercial and partnership registers. As of August 2023, it is also possible to notarise amendments to the articles of association of GmbHs and UGs (haftungsbeschränkt) via video conference.
As a matter of course, we offer notarisation via video conference in all cases where this is permitted. The condition for this is that
- the company is or should have its registered office in Aachen and the surrounding area, or
- at least one managing director of the GmbH lives in Aachen and the surrounding area, or
- at least one shareholder of the GmbH has their place of residence or registered office in Aachen and the surrounding area.
A German identity card or residence permit with eID is essential for video notarisation. This means that you must have a more recent ID card that can be read electronically and for which you have a PIN. If the ID card was issued before 2 August 2021, a valid passport must also be provided. Identity documents from other EU member states with a ‘high’ security level that have the above features can also be used.
